Dalam rangka mewujudkan penyelenggaraan bangunan gedung yang tertib, baik secara administrasi maupun secara teknis, setiap daerah kini mengharuskan adanya surat Sertifikat Laik Fungsi (SLF) untuk setiap pembangunan bangunan gedung. Dasar Hukumnya merupakan kelanjutan dari UU No. 28 tahun 2002 tentang Bangunan Gedung, PP No. 36 tahun 2005, serta Peraturan Menteri PU No : 25/PRT/M/2007 tentang Pedoman Sertifikat Laik Fungsi Bangunan Gedung. yang telah disempurnakan dengan terbitnya Peraturan pemerintan nomor 16 tahun 2021 tentang pelaksanaan undang undang bangunan gedung nomor 28 tahun 2008 ( dapat di download di sini )
Peraturan Menteri PU No : 25/PRT/M/2007 telah dijelaskan secara rinci dengan Peraturan Menteri PU No : 18/PRT/M/2018 dapat di download di bawah ini
Peraturan menteri pengganti untuk menyesesuaikan UU no 11 tahun 2020 tentang cipta kerja Peraturan pemerintan nomor 16 tahun 2021 tentang pelaksanaan undang undang bangunan gedung nomor 28 tahun 2008
- PERMEN PUPR NOMOR 23/PRT/M/20120 Perubahan atas Peraturan Menteri Pekerjaan Umum dan Perumahan Rakyat Nomor 27/PRT/M/2018 tentang Sertifikat Laik Fungsi Bangunan Gedung
SLF merupakan sertifikat yang diterbitkan oleh pemerintah terhadap bangunan gedung yang telah selesai dibangun sesuai IMB dan telah memenuhi persyaratan kelaikan teknis sesuai fungsi bangunan, berdasar hasil pemeriksaan dari instansi maupun jasa konsultan terkait.Pemeriksaan yang menjadi syarat dari kelaikan fungsi bangunan diantaranya adalah kesesuaian fungsi, persyaratan tata bangunan, keselamatan, kesehatan, kenyamanan, serta kemudahan bangunan gedung. Sehingga dalam hal ini, SLF harus dimiliki pengguna/pengembang bangunan gedung sebelum digunakan untuk kegiatan operasional. Beleid, UU No.28 Tahun 2002 itu tolak ukurnya adalah keandalan bangunan. Dilihat dari beberapa aspek. Diantaranya keselamatan, kesehatan, kenyamanan dan kemudahan. Jika layak secara administratif dan teknis, maka bangunan gedung dipandang telah andal dan dapat dimanfaatkan.
SLF diterbitkan pemerintah daerah dengan masa berlaku 5 (lima) tahun untuk bangunan umum dan 10 (sepuluh) tahun untuk bangunan tempat tinggal. Dengan begitu, sebelum masa berlaku SLF habis, pemilik bangunan harus mengajukan perpanjangan SLF dengan melengkapi beberapa dokumen lampiran.
Dokumen lampiran dimaksud adalah hasil Pengkajian Teknis Bangunan Gedung yang dilakukan para penyelenggara SLF yang memiliki IPTB (Izin Pelaku Teknis Bangunan) atau SKA (Sertifikat Keahlian) yang sesuai.
Penyelenggaraan SLF ini merupakan Pengkaji Teknis Bangunan Gedung yang ditempatkan berdasarkan PERMEN PUPR NO 27/PRT/M/2018 tentang Sertifikat Laik Fungsi Bangunan Gedung. serta Peraturan pemerintan nomor 16 tahun 2021 tentang pelaksanaan undang undang bangunan gedung nomor 28 tahun 2008
Penerbitan SLF sendiri telah diklasifikasikan ke dalam 4 (empat) kategori yang disesuaikan menurut jenis dan luasan bangunan. Empat kategori tersebut adalah sebagai berikut :
– Kelas A untuk bangunan non rumah tinggal di atas 8 lantai
– Kelas B untuk bangunan non rumah tinggal kurang dari 8 lantai
– Kelas C untuk bangunan rumah tinggal lebih atau sama dengan 100 m²
– Kelas D untuk bangunan rumah tinggal kurang dari 100 m²
Terus harus bagaimana ?
Berikut beberapa hal mendasar yang harus dipahami terkait proses penerbitan SLF :
1. Pengajuan pengurusan SLF melalui SIMBG
Setiap pemilik gedung bisa mengajukan permohonan SLF melalui sistem informasi bangunan gedung (SIMBG PUPR)
2. Penerbitan SLF membutuhkan rekomendasi beberapa dinas
Dinas dan badan pemerintah yang menentukan penerbitan SLF adalah Dinas Tenaga Kerja, Dinas Pemadam Kebakaran dan dan Perusahaan Listrik Negara (PLN).
3. Pemenuhan kewajiban sebelum pengurusan SLF
Untuk bangunan gedung di atas delapan lantai dan/atau di atas 5.000 m2, pengembang perlu menyerahkan bukti pemenuhan kewajiban dari pengembang ke kota berupa fasilitas umum dan fasilitas sosial sebelum mengurus SLF.
4. SLF Sementara sebagai pengganti SLF Definitif
Untuk pengembang yang mengalami kendala dalam pemenuhan kewajiban, dapat memohonkan SLF Sementara sebelum mengurus SLF Definitif. Masa berlaku SLF Sementara adalah enam bulan.
5. Masa berlaku SLF 5 hingga 10 tahun
Masa berlaku SLF 5 tahun untuk bangunan non-rumah tinggal dan 10 tahun untuk bangunan rumah tinggal. Sebelum masa berlaku habis, pemilik gedung harus mengajukan kembali permohonan perpanjangan SLF. Permohonan dilengkapi laporan hasil Pengkajian Teknis Bangunan Gedung oleh pengkaji teknis dari pengembang yang memiliki Izin Pelaku Teknis Bangunan (IPTB) bidang pengkaji bangunan.
6. Dampak tidak adanya SLF
Tanpa SLF, pengembang tidak dapat menerbitkan Akta Jual Beli (AJB), tidak dapat membuka cabang bank di gedung tersebut dan tidak dapat memungut biaya perawatan dari penghuni.
7. Kelengkapan sertifikat hunian
Selain SLF, pembeli sebaiknya mengecek sertifikasi dari pengembang, antara lain sertifikat Hak Guna Bangunan (HGB), surat Izin Mendirikan Bangunan (IMB), surat Izin Penggunaan Penunjukan Tanah (SIPPT), dan Sertifikat Hak Satuan Rumah Susun (SHSRS). Agar lebih valid, pengecekan dapat dilakukan dengan mendatangi instansi terkait. (
